To the maximum extent permitted by law, Poki shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising from or related to your use of the Services, even if we have been advised of the possibility of such damages. Our total aggregate liability shall not exceed EUR 50.

11. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users, us, or third parties. Upon termination, the licence granted to you in Section 3 ends immediately.

12. Governing Law & Jurisdiction

These Terms are governed by Dutch law, excluding its conflict‑of‑law rules. Any dispute arising out of or relating to these Terms or the Services shall be submitted to the exclusive jurisdiction of the courts of Amsterdam, The Netherlands, unless mandatory local law grants you additional consumer rights.

13. Dispute Resolution for EU Consumers

If you reside in the European Union, you may submit disputes for online resolution to the EU Commission’s Online Dispute Resolution (ODR) platform (ec.europa.eu/consumers/odr). We are not obliged to participate in alternative dispute‑resolution procedures and reserve the right to refuse involvement on a case‑by‑case basis.

14. Miscellaneous

• Severability: If any provision of these Terms is found unenforceable, the remaining sections shall remain in full force.

• No Waiver: Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.

• Assignment: You may not transfer your rights under these Terms without our prior consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
